General terms and conditions of the Pension Haus Erholung
1. Conclusion of the contract
The guest accommodation contract is concluded as soon as the room or apartment has been ordered by the guest and has been promised by Pension Haus Erholung or, in the case of short-term bookings, has been made available. The order, as well as the promise, can be made legally binding by telephone or in writing by mail, fax or e-mail.
The conclusion of the guest accommodation contract obligates the contractual partners to fulfil the contract, regardless of the duration of the contract.
The guest does not acquire any claim to the provision of specific rooms or apartments. The binding promise of certain rooms or apartments requires the written confirmation by Pension Haus Erholung.
Should agreed upon rooms not be available, Pension Haus Erholung is obliged to try to find an equivalent replacement.
2. Arrival and departure
Rooms are available from 2 pm. on the day of arrival, apartments from 3 pm. Should you arrive later than 18.00 o’clock, please let us know. On the day of departure the room/apartment is available until 11 am.
3. Services and prices
The contractual services result from the information in the reservation confirmation. Telephone information, additional agreements and other agreements of any kind are only part of the contract if they have been confirmed in writing by Pension Haus Erholung.
All prices are quoted in Euro, including value added tax. Payments are possible in cash, with EC-, VISA- or Master-Card.
4. Contract withdrawal (cancellation) by the guest
Cancellation is possible free of charge up to 14 days before the date of arrival. Decisive for the cancellation date is the receipt of the cancellation notice by us.
For cancellations and changes that are made late, as well as for no-show or interruption of travel, 80% of the price of the entire booking will be charged as a cancellation fee.
In case of early departure, the entire agreed price for the booked stay is due.
Until the beginning of your stay you can be represented by a third party. Otherwise the Pension Haus Erholung will make every effort to sublet the room. If a subletting is possible, you will not incur any costs for the subleased period.

5. Withdrawal from the contract by Pension Haus Erholung
The Pension Haus Erholung reserves the right to withdraw from the contract if the provision of the service has become impossible due to force majeure, without the right to claim damages.
6. Liability
The guest is liable to Pension Haus Erholung for any damages caused by himself during the contract period.
If the guest is provided with the house’s own parking spaces, no safekeeping contract is concluded. There is no duty of supervision by the pension. The guesthouse is not liable for any damage to the vehicle.
7. Final provisions
In commercial transactions, the place of performance and jurisdiction is Cochem. The law of the Federal Republic of Germany applies.
Should individual provisions of the contract or of these General Terms and Conditions be invalid, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by the corresponding version of the BGB/HGB.

Important note on the right of withdrawal!
Please note that according to the legal regulations (§ 312g Abs. 2 Satz 1 Ziff. 9 BGB) for guest accommodation contracts (contracts for accommodation with and without additional services), even if they were concluded by means of distance selling (by telephone, online, fax or e-mail), there is no right of withdrawal (i.e. no right of withdrawal free of charge), but the legal regulations of the rental contract law (§ 537 BGB) apply. After conclusion of the contract, unless a right of withdrawal free of charge has been expressly agreed upon, the only possibility of withdrawal or cancellation subject to a fee is therefore the withdrawal or cancellation in accordance with the business conditions of the host (insofar as these have been effectively agreed upon) or in accordance with the statutory provisions.
